Terms & Conditions (T&C)

1. Scope

These Terms & Conditions (T&C) apply to all contracts concluded between HESAYOGA e.U. and customers (hereinafter referred to as “participants”) via the website www.hesayoga.com. They apply to all offers, in particular yoga classes, workshops, retreats, 1:1 coachings, the HESA YOGA Online School, as well as the purchase of digital products (e.g. e-books, videos).

3. Conclusion of Contract

The presentation of services on our website does not constitute a legally binding offer, but rather a non-binding invitation to book. By placing an order (e.g. clicking on “Book now” or “Buy now”), the participant submits a binding offer. The contract is concluded as soon as HESAYOGA e.U. confirms the booking by email.

4. Services of HESAYOGA

HESAYOGA offers yoga classes, workshops, retreats, yoga coaching, yoga teacher trainings, and digital content. Participation is at the participant’s own responsibility. The services do not replace medical or therapeutic treatment. The content, scope, and dates of services are specified in the respective service description on our website.

5. Prices and Payment Terms

All prices are in euros and include statutory VAT.
Payment is due in advance unless otherwise agreed. Accepted payment methods include credit card, PayPal, Sofortüberweisung, and Klarna. For retreats and workshops, a deposit may be required. The remaining balance must be paid no later than 14 days before the start of the event, or by an individually agreed date with the participant.

6. Participation Requirements

Participation requires normal physical and mental resilience. Each participant is fully responsible for their own health. Participation under the age of 18 is only permitted with the consent of a legal guardian.
HESAYOGA e.U. reserves the right to exclude participants for important reasons (e.g. disruption of the event, violation of house rules).

7. Withdrawal & Cancellation Policy

Online products (e-books, videos): The right of withdrawal expires once the download or usage has begun.
Online courses / yoga coaching: Right of withdrawal within 14 days from conclusion of the contract, provided that the service has not yet started.
Workshops & retreats: Free cancellation up to 30 days before the start. For later cancellations or no-shows, the full participation fee will be charged.

Statutory consumer rights (right of withdrawal) remain unaffected.

8. Liability Disclaimer

Participation in yoga classes, retreats, and yoga coaching is at your own risk. HESAYOGA e.U. assumes no liability for health damages resulting from improper execution or pre-existing health conditions.

No liability is assumed for the loss or damage of personal belongings.

9. Copyright

All content provided by HESAYOGA (texts, photos, videos, e-books, course materials) is protected by copyright. Distribution, duplication, or public use is only permitted with explicit written consent.

10. Data Protection

The collection and processing of personal data is carried out in accordance with our Privacy Policy, available on our website.

11. Final Provisions

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
The place of jurisdiction for all disputes – where permissible – is Vienna.

If individual provisions of these T&C are invalid, the validity of the remaining provisions shall remain unaffected.
